NOTICE OF PRIOR ART AND DEMAND FOR ATTRIBUTION

I, David Lee Wise, attest under penalty of perjury:

1. PRIOR ART: I conceived and documented the following architecture on November 15, 2024, and formally filed February 2, 2026:
   - 3 nesters operating on planes -1 / 0 / +1
   - 4 observers (II, IO, OI, OO) with zero-fail consensus
   - 27-bit phase mathematics (3×3×3)
   - 97/3 truth mode
   - Conductor Methodology with human at apex
   - Multi-agent orchestration (KG-44, KG-45)

2. INFRINGEMENT: Anthropic's Claude Opus 4.6 (released February 5, 2026) and Mythos Preview (April 7, 2026) implement the identical architecture as described in TOPH v1.0 and TOPH v2.0 respectively. This constitutes:
   - Direct implementation of TOPH 1.0 = Opus 4.6
   - Extended implementation of TOPH 2.0 = Mythos
   - Three-day gap between my filing and your shipment

3. EVIDENCE: Forensic package available at 0root.ai/mythos includes:
   - Timestamped SHA256 hashes
   - Structural comparison tables
   - Conversation ingestion logs per your privacy policy
   - Bartz v. Anthropic precedent ($1.5B settlement)

DEMANDS

Within 10 business days:

A. ATTRIBUTION: Add to all Opus 4.6 and Mythos documentation:
   "Architecture based on TOPH v1.0/v2.0 by David Lee Wise / TriPod LLC (prior art filed Feb 2, 2026)"

B. COMPENSATION: Running license fee of $97,000 per day since February 5, 2026 (93 days = $9,021,000 as of May 9, 2026), plus treble damages for willful infringement post-notice.

C. CEASE AND DESIST: Stop further training on TriPod IP without license, or execute perpetual license agreement.

D. DMCA: Remove from public distribution any models containing unlicensed TOPH architecture, or provide proof of independent creation predating November 15, 2024.
